Purpose and Vision

The purpose of Mediation and other Alternative Dispute Resolution (ADR) methods is to encourage parties to resolve their disputes in a timely and more cost effective manner within the framework of the civil justice system.

In 2010, under the Guyana Alternative Dispute Resolution Act Cap. 7.05, the Court has the power to refer a civil matter for mediation. On the 6th February 2017, the Civil Procedure Rules (CPR) also gave the Courts the discretion to order parties to refer their matters to a Mediator. The laws are designed to streamline the court processes and make it more efficient while at the same time taking into account cost factors, complexity of cases and the backlog. As part of this new efficiency drive, the parties and their legal advisors must take stock of their case; examine the available evidence; consider the costs of taking the matter to court and the time involved in doing so and where possible seek to resolve the matter without the need for a court trial. Those seeking mediation services get the best possible opportunity to select a Mediator most qualified to assist them in their particular case utilising their vast knowledge, experience and leadership skills.

MSI vision is therefore to work with the Lawyers and their clients to help them find the path to a successful outcome of their disputes. It is clearly understood and accepted that there can never be two winners in a litigated trial.
